This website is for sales direct to consumers. Businesses can make purchases by calling our office on 01942 701210.

By accessing or using our website you agree to be bound by these Terms & Conditions. We reserve the right to suspend or prevent access to the website if you fail to comply with these Terms & Conditions or any applicable laws.

Product Information & Pricing

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur.

Prices on our website are listed in UK pounds sterling and are exclusive of VAT (unless stated otherwise on product pages). Customers that are eligible for VAT relief should complete the VAT exemption certificate provided with every order and return to the address provided on the receipt. Please note that there are severe penalties for making a false declaration of eligibility for VAT relief. Evergreen Nebulisers will not zero-rate goods if we believe that a customer is not entitled to VAT relief. If this is the case your order will be cancelled and you will be notified via email. If you are in any doubt about your eligibility for VAT relief you should seek advice from HMRC. More information on VAT relief can be found Here.

In the event of any products being unavailable or if we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of cancelling your order or reconfirming your order at the correct price. If we are unable to contact you then we will treat the order as cancelled. If you cancel and you have already paid for the goods then you will receive a full refund.

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

Your goods may vary slightly from the image shown on the website and may not include all of the pictured accessories, unless stated in the specification of the goods. Whilst goods may be shown with attached accessories, this may require assembly by you.

Making a purchase

You can use our website to make a purchase by selecting the product(s) you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.

When you place an order with us, you are making an offer to buy goods. You will receive an email to confirm that we have received your order. This acknowledgement does not mean your order has been accepted.

We may, in our absolute discretion, contact you to say that we cannot accept your order. If this is the case we will let you know the reason your order cannot be accepted.

If purchasing a quote, the buyer accepts full responsibility for checking the accuracy of that quote.

You will be required to pay for the goods in full at the time of ordering.

We use a secure payment partner, Stripe, for online purchases. You can pay for your order with Visa, Mastercard, American Express. You can also pay using PayPal.

We will do all that we reasonably can to ensure that the information you supply during payment is secure. However, in the absence of negligence on our part, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information you provide to us.

Once your order has been processed and completed we will notify you. This notification serves as acceptance of your order and that a contract has been formed between us.

Changes to your order may not be possible after your order has been accepted and dispatched. If changes are possible they may incur additional charges and/or delays.

Delivery

Your items will be delivered to you within 30 days after the day on which we accept your order.

We will deliver to the address you provide when you place your order. We cannot be held responsible for missing or failed deliveries due to incorrect addresses supplied.

Every reasonable effort will be made to deliver the goods as soon as possible after your order has been received. However, we will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

For orders delivered by Royal Mail:

If you are not available to accept your order at the time of delivery your postman may either leave the parcel in a safe place, with a neighbour or at your local sorting office for collection. If you do not collect the parcel after 7 days it will be returned to us. In this case we will not cover the cost of re-delivery to you.

If you have not received your order within 5 days of notice of dispatch you will need to check that it has not been left at your local sorting office before contacting us. As it is not possible to track items sent via Royal Mail it may be necessary to wait up to 10 working days before it can be assumed that a delivery is missing.

If it is important that delivery is received promptly we would recommend using the courier service as it can be tracked.

For orders delivered by Courier:

As a signature will be required on delivery there needs to be somebody present at the delivery address. If nobody is at the address the courier will leave a card advising you of what to do to receive your order. We may try to contact you to arrange re-delivery but this is not always possible. If we cannot contact you the parcel will be returned to us. Any subsequent deliveries for that order will be subject to a delivery charge of £6.00.

Cancellations, Returns & Refunds

Your right to cancel an order for goods starts the moment you place your order and ends 30 days from the day you receive your goods.

If you wish to cancel an order, for any reason, you must notify us within this 30 day period, via email or phone, and provide us with your name, address, telephone number, order number, and details of your order.

If you cancel your order after we have despatched it then you must return the item(s) within 30 days of your cancellation notification at your own cost.

We are happy to arrange a courier service for items to be returned for a fee of £15.00.

If you cancel your order we will refund to you the price paid for the item(s) including basic delivery costs, to the original method of payment.

We reserve the right to make deductions to the amount refunded to reflect any reduction in value of the item(s).

Any claim in respect of faults in the goods supplied should be made, via email or phone, within 30 days of receipt of the item(s).

All refunds will be processed within 14 days from the day on which we receive the item(s) back from you.

Testimonials

We reserve the right to publish any comments received from customers on our Testimonials section on our home page.

The comments may be published in full or in part.

The customer's contact information will not be displayed.

If any individual does not wish for their name, location and comments to be published on our Testimonials section then this must be clearly stated in written correspondence.

Limitation of Liability

To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of this website or any information contained therein.

You should be aware that your use of this website and its content is at your own risk.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these Terms & Conditions.

Entire Agreement

These Terms & Conditions, together with the Privacy Policy, VAT Relief terms, Delivery terms and Refunds & Returns terms constitute the entire agreement between you and us and supersede and extinguish all previous agreements, assurances, warranties, representations and undertakings between us, whether written or oral.

Pari O-PEP offer

The Pari O-PEP offer is valid only for returning customers using the code displayed on their invoice/receipt.

The offer is valid until the date shown on the receipt.

Eligible customers can claim a discount of £10 off a Pari O-PEP Mucus Clearance Device purchased online from the Evergreen Nebulisers website using the discount code provided at checkout.

No other products are included in the offer and there is no cash alternative.

Evergreen Nebulisers reserves the right to cancel and/or withdraw the offer at any time.
